 · The Practice Manual is a comprehensive guide that sets forth uniform procedures, recommendations, and requirements for practice before the Immigration Courts. The requirements set forth in this manual are binding on the parties who appear before the Immigration Courts, unless the Immigration Judge directs otherwise in a particular case.  · Motions must be filed with a cover page and comply with the requirements for filing. See Chapter 3 (Filing with the Immigration Court), Appendix E (Sample Cover Pages). In addition, all motions must be accompanied by the appropriate proposed order for the Immigration Judge’s signature. Motions and supporting documents should be assembled in.  · See Chapter (e) (Evidence). It should also include the date and time of the hearing, as well as preferred dates that the party is available to re-schedule the hearing. However, parties should be mindful that the Immigration Court retains discretion to schedule continued cases on dates that the court deems appropriate.


Chapter 1 The Immigration Court. Scope of the Practice Manual (a) Authority —. The Executive Office for Immigration Review (EOIR) is charged with administering the Immigration Courts nationwide. The Attorney General has directed the Director of EOIR, in consultation with the Immigration Judges, to issue an Immigration Court Practice Manual. The Immigration Court Practice Manual does not include any special procedures for motions to terminate. Therefore, a motion to terminate should be filed in accordance with the general motion procedures set forth in Chapter of the practice manual. No fee is required to file a motion to terminate.
